Terms of Service and Privacy Policy for Maccabi Go

1.2 The Service offers viewing live video content and VOD service, at a monthly fee, according to the terms and conditions set out in the document below.

1.3 In addition to and without derogating from the terms set out in the document, the use of the service is subject to the terms of use and privacy policy of the Maccabi Tel Aviv Football Club Website and the Maccabi Tel Aviv Application and are available at https://www.maccabi-tlv.co.il/en/info/privacy-policy/ (hereinafter: “The Additional Terms”), on behalf of Maccabi Tel Aviv Football Club Limited Partnership (“Maccabi”).

1.4 The terms “you” and / or “user” refer to the user of the service. The use of the masculine in these Terms of Use is made for convenience only and refers to both male and female. Wherever the provisions of the Terms of Service are addressed to an individual, these provisions shall also apply to many, and vice versa. Section headings for the Terms of Service are for orientation purposes only and shall not be used for interpretation.

2. Acceptance of the Terms of Service

Your use of the Service is subject to the terms set out in this document and to the Additional Terms (collectively: “Terms of Service”) and the fact that you are registered with the Service constitutes confirmation that you have read and agree to the Terms of Service. If you do not agree to the Terms of Service, then do not register or use the Service. The user is fully responsible for the understanding of the Terms of Service, as updated from time to time.

3. Registration and use of the Service

3.1 In order to register for the service, you must complete the registration form on the website or on the app. When registering for the service you will be asked to provide a number of personal details. You must provide correct and full details, and their delivery constitutes a declaration by you of their correctness. Please note that submission of false information is a criminal offense and one who does so is subject to criminal and civil proceedings.

3.2 You undertake not to use the password and user name of another and not to provide your password and user name to any third party. It is important that you keep the details confidential because you may be responsible for their use (including payment), even if done without your consent. We recommend changing your password from time to time.

3.3 You will not be able to view the contents of the service simultaneously from two different devices (computer/smartphone/tablet) by the same user.

3.4 You hereby declare that you will not use the Service for purposes other than its purposes in accordance with the Terms of Service and will not make illegal use of it for improper purposes, including, inter alia, that you will not use it for:

3.4.a. Disruption, disruption, limitation or denial of use of the Service;

3.4.b. Uploading content and/or information that may hurt, insult, defame, defame, threaten, or that it may constitute offensive, vulgar, or pornographic material or that it is prohibited to publish or use;

3.4.c. Uploading content and/or information that are inaccurate and/or false and/or distorted and/or misleading and/or false;

3.4.d. Receiving information that you are not authorized to view and/or illegally accessing areas and/or parts of the Service that you are not authorized to access and/or receiving information from other computers and/or other users;

3.4.e. Uploading content and/or information that may harm Maccabi and/or Sport 1 and/or other users, such as harmful software, code lines, viruses, “Trojan horse” or any other program that may damage the proper operation of the Service and/or use of it.

4. Compatibility testing and viewing quality

4.1 For the avoidance of doubt, Maccabi and/or anyone on its behalf is not responsible for the compatibility of the service, its quality, availability, timeliness, reliability and/or malfunction, defect and/or incompatibility related to the use and viewing of the service.

4.2 In order to use the service, make sure that your Internet connection is working and that the connection speed is more than 1000 kilobytes per second (download). It is the responsibility of the user to ensure that all the computer equipment in their possession is correct and that all the necessary software is installed for viewing the video on the Internet.

4.3 User is aware that the use of the service depends on the proper operation of complex communication systems, some of which are not under the control of Sport 1 and/or Maccabi. Accordingly, Sport 1 and Maccabi are not responsible and shall not be liable for any prevention and/or malfunction and/or damage to the possibility of transferring the service to the end equipment of the user/or use of the service. As far as Sport 1 is concerned, they will make an effort to resolve any such prevention or problem.

4.4 Without diminishing from the generality of the above, Sport 1 and Maccabi are not committed to the continuous operation of the service. It is possible that the activity of the site will be interrupted or stopped for various reasons, and you declare that you will have no claim to Sport 1 and/or Maccabi in connection with this. Sports 1 and Maccabi may not be liable for any malfunction, failure, strike or force majeure event, whether on the Internet or in the broadcast equipment or the end user equipment, which will cause disruptions in the provision of the service.

5. Paid service

5.1 The service is a paid subscription service.

5.2 The subscription fee will be paid each month in advance for the following month. You can not purchase a subscription for less than a month.

5.3 Payment of the subscription fee for those who purchase the service should be made through the website using the PayPal account or credit card of the user whose details were provided by the user at the time of purchase of the service.

5.4 The date of actual charging of subscriber fees will be determined in accordance with the terms of the agreement between each of the users and the relevant credit company.

6. Cancellation policy and refunds

6.1 Without derogating from the provisions of any law, a subscription may be canceled subject to and in accordance with the Terms of Service, including all the details of this section (with regard to its links and references). Cancelling the Service is the responsibility of the user.

6.2 Cancelling a subscription purchased through the website is done directly from your PayPal account. Click here to for the explanation as to how to cancel.

6.2 Please Note! Cancellation will take effect after the end of the month of service in which the cancellation request was received, meaning that the Subscriber will be charged the subscription fee for the month of the service in which the subscription was cancelled, and thereafter shall cease being charged.

6.3 Cancellation of Subscription shall not be refunded, unless Sport 1 decides otherwise, depending on the circumstances of the case. Insofar as it will be decided to credit the user, the credit will be carried out on the user’s credit card on the date and on the terms to be determined by the credit and clearing companies.

6.4 In case of cancellation in accordance with the Consumer Protection Law, 5741-1981 (hereinafter: “the Consumer Protection Law”), the amount paid by you for the service shall be returned to you, less a cancellation fee at the rate of 5% of the amount of the transaction. Request for cancellation according to the Consumer Protection Law stating the reason for the cancellation should be sent in writing to  maccabi@mtafc.com.

7. Changes

7.1 Sport 1 and Maccabi reserves the right to change the Terms of Service, all or any part thereof, including the amount of subscription fees for the Service. Such changes, if any, will be posted on the website.

7.2 Sport 1 and/or Maccabi may change from time to time the structure, appearance and design of the Service (subject to Maccabi’s approval), the scope and availability of the broadcasts and/or any other aspect of the Service – all of the above without prior notice. In addition, Sport 1 and Maccabi may offer additional and/or various subscription services from time to time, in their scope, content and/or price, as well as various benefits and promotions for all users and/or some of them, registered users and/or new users.

7.3 Given the dynamic nature of the Internet and various technological changes that have an impact on the service, there may be adjustments and/or improvements and/or maintenance work. It is hereby clarified to the users that by their very nature, such changes may involve mishaps and/or inconvenience, etc., and that the users will not have any claim and/or claim and/or demand against Sport 1 and/or Maccabi and/or anyone acting on their behalf for such changes and/or malfunctions that may occur due to or in the course of their execution.

7.4 Sport 1 and Maccabi reserve the right to prevent and/or suspend and/or permanently suspend access to the Service and/or parts thereof, to a single user and/or to some users and/or to all users, all at their sole discretion and without prior notice.

7.5 Without derogating from the aforesaid, Sports 1 and/or Maccabi may prevent the use of the Service, in any event where:

7.5.a. The conditions of service were violated.

7.5.b. Incorrect and/or incomplete details and/or incorrect and/or false information was provided by a user.

7.5.c. An act or omission was committed that may cause concern of damage to Maccabi and/or Sport 1 and/or to anyone on their behalf and/or to other users.

8. Privacy

8.1 As mentioned in this document above, the use of the Service is subject to the Additional Terms (as defined above), including the Maccabi policy regarding the usage privacy specified in the Additional Terms, with the necessary changes. Maccabi will be entitled to make use of any information about you, including any information you provided when registering for the Service and/or Maccabi FIRST, information collected (if collected) during the use of the Service and any other information of any kind, subject to and in accordance with the Additional Terms and the provisions of the law.

8.2 For the avoidance of doubt, the provisions of this Section, Section 8 shall not derogate from any rights of Maccabi.

8.3 Sport 1 will not transfer identifying information about you to a third party, other than credit card companies, and any judicial instance if there is a legal obligation to transfer the information about you to another.

8.4 The information provided at the time of registration for the Service, in whole or in part, shall be kept in the databases of Sport 1 and in the databases of the companies operating the Service for Sport1.

8.5 Sport 1 reserves the right to collect information when you are using the Service, information about products/services you have purchased, products/services in which you have expressed interest, pages you have viewed, and any other information, including through the use of Cookies (the Information”).

8.6 The information will be used by Sport 1 on your next visit to the site and will enable Sport 1 to offer you targeted offers and promotions.

8.7 Sport 1 may use your personal information and any information stored about you when using the site for the purpose of producing and analyzing statistical information.

8.8 Sport 1 shall be entitled to provide statistical and other data to third parties, provided that the data does not relate to you personally or identify you personally.

8.9 Sport 1 commits to use its best means of its ability, in order to maintain the confidentiality of the users’ information and to secure the information stored in the Service. However, since this is an online environment, Sport 1 and/or Maccabi can not guarantee absolute prevention of penetrations into its computers or the disclosure of information stored in them. To that extent and to the extent that a third party gets into the information presented or used for abuse, you agree that you will not have and claim or demand against Sport 1 and/or Maccabi and/or any of its representatives.

8.10 It is clarified that Sport 1 does not store the credit card details with which the purchase of the service is made on the site.

9. Jurisdiction

9.1 These Terms of Service, and all that arises from them or is related to them, shall be governed solely by the laws of the State of Israel.

9.2 The sole jurisdiction of any matter relating to this Agreement, to the terms and conditions and any matter relating to the use of the Service, whether directly or indirectly, is in the competent courts in Tel Aviv-Jaffa.

9.3 In the event that any part of the Terms of Service is determined to be invalid or unenforceable, then the revoked or unenforceable terms shall be deemed to have been replaced by enforceable terms, the content of which is the closest approximation of the intent of the Original Terms and the remainder of the Terms of Service shall remain in force.

10. Subscriber support and service

10.1 The service includes a subscriber service center. The hotline’s hours are Sunday through Thursday, between 10:00 and 17:00.
